1. Agreement to Terms

By accessing our website (whyfaithe.com), downloading free resources, purchasing software licenses or blueprints, subscribing to updates, or submitting an application for a free website build, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Store Purchases & Software Licensing

We offer both free and paid digital products (including WordPress plugins, iOS shortcuts, and Make.com blueprints):

• Paid Product Licensing: Purchases of Efish CPT Calendar Block Pro are subject to a per-site activation license. Each license allows activation and use on a single production website. Redistribution, white-labeling, or reselling of the plugin files is strictly prohibited unless written consent is provided.
• Free Downloads: Free iOS shortcuts, blueprints, and templates are licensed for personal and internal business use only. You may modify them for your own use, but you may not resell them as standalone templates or packages.
• Digital Nature & Refund Policy: Because our products are digital downloads that are delivered instantly via link or email, all sales are final. We do not offer refunds, returns, or exchanges under any circumstances once download access has been provided. Please review compatibility and system requirements prior to purchasing.

3. Website Build Funnel Applications

We offer an application program where select users can apply to receive a free custom website build. By applying, you agree to the following conditions:

• No Guarantee of Selection: Submitting an application does not guarantee you will be selected for a build. We review applications and choose fits at our sole discretion. We are under no obligation to provide feedback or reasons for non-selection.
• Ownership and Permissions: You guarantee that you own, or have obtained explicit legal permission for, all photos, logo files, text descriptions, bios, and links submitted in your application. You agree to indemnify whyFaithe and Faithe Yates against any third-party claims of copyright infringement related to your submitted materials.
• Content & Publicity License: If you are selected, you grant whyFaithe and Faithe Yates a non-exclusive, worldwide, royalty-free, perpetual license to record, stream, photograph, write about, and publish the process of building your site and the final completed website. This includes using your name, photos, bio, and social handles in videos, case studies, social media posts, and marketing materials.
• Deliverables and Scope:The free starter site is built as a static one-page site. Upgrades (such as launch assistance, custom backend updates, multiple pages) are optional and require separate paid agreements. Free builds are provided "as-is" without any warranty of performance, ongoing support, or hosting.

4. Email Marketing and Newsletter Updates

By signing up for updates, applying for a website build, or checking the newsletter box during order checkout, you subscribe to receive newsletter updates, announcements, and offers.

You may unsubscribe at any time using the opt-out mechanism included in each email. We reserve the right to suspend or terminate subscriptions for any users who display abusive behavior or use automated scripts to sign up.

5. Limitation of Liability

In no event shall whyFaithe, its owner Faithe Yates, or any affiliates be liable for any damages (including, without limitation, damages for loss of data or profit, server downtime, site crashes, or business interruption) arising out of the use or inability to use the digital templates, iOS shortcuts, WordPress plugins, or custom built websites, even if we have been notified of the possibility of such damage.

As-Is Software:All downloadable tools, plugins, shortcuts, and blueprints are provided "as-is" and "as-available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

6. Intellectual Property

The website design, layout, source code, logo, brand assets, and custom illustrations are the intellectual property of whyFaithe / Faithe Yates. You may not copy, scrape, modify, redistribute, or republish the proprietary content of this site without our prior written consent.

7. Governing Law

Any claim relating to whyFaithe's website or services shall be governed by the laws of the State of Florida (or our active local jurisdiction), without regard to its conflict of law provisions.
